NZSA Website General Conditions of Use
This website (www.anaesthesiasociety.org.nz) (Site) is owned and operated by the New Zealand Society of Anaesthetists Inc (NZSA). All material, text, logos, graphics and advertisements on the Site are the copyright of NZSA or are reproduced with the permission of the copyright owner (collectively “information”).
You must not copy, adapt, reproduce, store, publish or commercialise any information provided on the Site without NZSA’s prior permission.
Where a copyright owner’s information or work is reproduced or otherwise utilised there must be attribution to the original author or copyright owner.
Your access to and use of the Site constitutes your acceptance of these Conditions of Use which take effect from the date of first access to the Site. Each page of the Site must be read in conjunction with the Conditions of Use.
Conditions of Use
- The Site has been developed as a service of NZSA. NZSA takes reasonable steps to ensure the content of the Site is accurate at the time of publication but does not warrant its accuracy.
- NZSA does not accept responsibility or liability for any errors or omissions contained in the Site and reserves the right to change, delete, add or otherwise amend content at any time without notice.
- In respect to information which has been reproduced with the permission of any other copyright owner or author, NZSA expressly does not accept responsibility or liability for any such content, and makes no warranty as to its accuracy.
- The contents of the Site are intended to be general in nature. As such they can not be tailored to any individual circumstance or person, and should not be construed as substituting for individual medical or professional advice. They should also not be relied on as the basis for any decision or action in the absence of seeking individual medical or professional advice. Specific advice about your personal health circumstances from qualified professionals, including your individual Anaesthetist, or other registered health practitioners (e.g. your general practitioner or Surgeon) where applicable, should therefore be sought before undertaking any action based on information received from the Site.
- Any products, processes, or services accepted for inclusion on the Site must comply with all relevant advertising standards and enactments such as the Fair Trading Act 1986. Any inclusion of, or reference to any specific products, processes, or services does not however constitute an endorsement or recommendation by NZSA.
- Purchase of any products or educational resources from the Site will result in collection of personal information, but use of such information will be limited to the purposes for which it was given, apart from any audit or other legal requirements.
- The Site contains links to other websites. NZSA is not responsible for the content of those linked sites and takes no responsibility for the content or accuracy of materials on such linked websites. If you decide to access these websites, you do so at your own risk.
- NZSA disclaims any liability to the maximum extent permitted by law for any loss or damage which you may directly or indirectly suffer in connection with your use of the Site.
- NZSA does not guarantee the Site will be available at all times, or at all. Access to the Site may be terminated at any time by NZSA without notice or compensation to you. There will be no right of redress in the event NZSA terminates provision of or access to the Site.
- These Conditions of Use are governed by the laws of New Zealand. NZSA does not represent or warrant that the information on the Site, whether entered in New Zealand or elsewhere, complies with the laws or regulations of any other country.
- NZSA may revise these General Conditions of Use at any time and post any amendments to the Site. All amendments are binding on users of the Site from the time of posting by NZSA.
Website Special Conditions of Use
- These Special Conditions of Use relate to your access to the Members Only section of the Site and are to be read in conjunction with the General Conditions of Use which are incorporated into and form part of these Special Conditions of Use.
- Access to the Members Only section of the Site is restricted to members of NZSA who have completed a registration process and obtained a password.
- NZSA will carry out a validation check to verify the identity and NZSA membership of all applicants prior to issuing a password to the Members Only section of the Site.
- NZSA will treat all information provided as part of the registration process as confidential. In particular, NZSA will comply with the Privacy Act 1993 as it applies to the protection of personal information obtained by it through the registration process.
- Access to the Members Only section of the Site is granted to an individual member. Access to the Site by other persons using a member’s personal password is strictly prohibited. It is the responsibility of each member to protect the password and to not allow its use by any other person.
- When using the Members Only section of the Site for any permitted purpose you must not use misleading, obscene, inflammatory, libellous or defamatory language and you must not promote or exhibit materials of a sexually explicit or violent nature, or otherwise interact with the Site in a way which discriminates on any of the grounds prohibited by the Human Rights Act 1993 (e.g. racial, religious, gender, disability, sexual orientation or nationality basis) or under any other enactment.
- NZSA recognises that divergent medical opinions may exist amongst its Members and NZSA expressly takes no responsibility and accepts no liability for accuracy or validity of medical opinions expressed on the Site, whether in the Members Only section or elsewhere.
- NZSA reserves the right to monitor the Site and remove any offending content at any time without notice and to remove access to the Site to any member by deactivating a password at any time without notice for any breach of these Special Conditions of Use.
- You must at all times use the Members Only section of the Site in a manner that is consistent with the Code of Ethics for the Medical Profession including but not necessarily limited to the 12 principles contained therein.
- You must at all times use the Members Only section of the Site in a manner that is consistent with the duty to maintain the privacy and confidentiality of information about patients’ health and treatment and to collect, store and use that information in strict accordance with the Privacy Act 1993, Rule 6 of the Health Information Privacy Code 1994 and the Code of Practice for the Health Practitioner Index.
- NZSA may from time to time poll members through the Members Only section of the Site on a range of issues of interest to NZSA. Members will be asked to submit a yes or no answer to determine the results of any poll. You may, in addition, provide free text comment on any poll. These comments, together with the details of the poll, will be available to be viewed by the poll administrator but will remain confidential and will not be visible or accessible to any other NZSA member. NZSA will exercise due care in collating responses to such polls but does not take responsibility for or warrant the accuracy of poll results.
- You should be aware that any communication or information which you post to this Site must be considered to be non-confidential. You are therefore taken to have waived rights of privacy or confidentiality in respect to any personal, health or confidential information you post on the Site. For the avoidance of doubt, this does not apply to any information you may post in respect to the Australia New Zealand Tripartite Anaesthesia Data Committee, whose server is located outside of New Zealand and to which NZSA merely provides portal access. That site is governed by its own rules, which Members should read before entering any posting on that site.
- Members accessing the Pacific Society material hosted on the NZSA Site acknowledge that NZSA does not take any responsibility for the Pacific Society material and specifically does not make any warranty as to its currency, accuracy or reliability.
- You will refer any questions that you receive from any media person or organisation in respect of any content on the Site to the CEO of NZSA for a response. You are not permitted to discuss any aspect of the Site or your use thereof with the media at any time.
- NZSA does not guarantee the truthfulness, accuracy or reliability of any communication posted on the Site and expressly can not be taken to agree with or endorse any opinions or information expressed by Members posting on the Site.
- You agree to indemnify and hold harmless NZSA, its officers, employees and agents from and against any claims or demands including reasonable legal or other professional services fees due to or arising out of your use of the Site or any breach of the General and Special Conditions of Use. In the event of any claim, NZSA will notify you promptly of such claim but reserves the right to assume and conduct the defence of any claim. In that event you will take all reasonable steps to assist NZSA in asserting any available defence.
